Preamble 

These terms and conditions ("Terms") govern the access to and use of LOQT website, mobile application and any other LOQT services that are now or may become available (individually and collectively referred to as "LOQT") of Do It Get It Ltd ("we/us"), made available to users ("you" or "user/s"). 

Use of Product 

LOQT is intended for personal use only, in accordance with all applicable laws. You may not use LOQT for commercial purposes. As a condition to your use of LOQT provided by us, you agree not to use LOQT for any purpose that is unlawful or prohibited by these Terms. You may not use LOQT in any manner that could damage, disable, overburden, or impair our server, or the network(s) connected to any of our servers, or interfere with any other party's use and enjoyment of LOQT. 

Full use of LOQT requires internet access and certain software may need updates; and may be affected by the performance of these factors. We do not guarantee any third party product or service offering. The provider of internet access for your device may charge you fees in connection with your use of LOQT. You are solely responsible for any internet access fees or other charges you incur. 

You are responsible for all activities undertaken under your account. 

Where LOQT is used by a school, the school is the Data Controller and LOQT (Do It Get It Ltd) is the Data Processor, as defined by the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. The school determines why LOQT is used and how personal data is processed within the school environment. 

Where LOQT is used directly by a family without a school, LOQT (Do It Get It Ltd) acts as both Data Controller and Data Processor. 

By downloading or using any services related to LOQT, you represent and warrant that you are legally permitted to install LOQT on all devices for which you install LOQT. LOQT is a tool for users to control activity performed on devices on which LOQT has been installed. The usage of LOQT is

entirely the responsibility of the users. We have no responsibility for the level of usage or limitations defined by the users of LOQT. We are not responsible in any way whatsoever for any loss of usage time, availability or access to devices in which LOQT is active. 

License Grant 

Subject to the Terms contained herein, we hereby grant to you a limited, non-transferable, non-sublicensable, non-assignable and revocable license to install and use LOQT solely for your own personal, non-commercial use on your present device that you own or control. LOQT is licensed to you and not sold by us pursuant to and subject to the terms and conditions of this agreement and any other applicable terms and conditions promulgated by any third party (including without limitation Google Play and other operators). We reserve all rights not expressly granted to you herein. 

Payment 

Payment will be made in accordance with the payments structure set forth on our website as updated from time to time. Requests for refunds will be dealt with individually by our internal team. 

User Account 

Your use of LOQT may require you to establish an account with us. You must complete the registration process by providing current, complete and accurate information as prompted by the applicable registration form. You are entirely responsible for maintaining the confidentiality of your phone number and your account access. You are entirely responsible for any and all activities that occur under your account. You agree to notify us immediately of any unauthorised use of your account or any other breach of security. We will not be liable for any loss that you may incur as a result of someone else using your mobile phone number or account, either with or without your knowledge. 

You will not use LOQT for anything other than its intended purpose or exploit any errors in design, features which have not been documented, or bugs to gain access in any way that is not generally known and intentionally made available by us. 

Intellectual Property 

We own all right, title and interest in and to LOQT, including, without limitation, all intellectual and proprietary rights appurtenant thereto. The entire content (including without limitation images and text) of LOQT is copyrighted and may not be reproduced, published, broadcast, posted, modified, transmitted, displayed, distributed, downloaded or otherwise used without our express written 

permission. 

Warranty Disclaimer

You expressly acknowledge and agree that use of LOQT is at your sole risk and that the entire risk as to satisfactory quality, performance, accuracy and effort is with you. To the maximum extent permitted by applicable law, LOQT and any services performed or provided by or in connection with LOQT are provided "as is" and "as available", with all bugs and faults and without warranty of any kind. We hereby disclaim all warranties and conditions with respect to LOQT, either express, implied or statutory, including, without limitation, any implied warranties of merchantability, of satisfactory quality, of fitness for a particular purpose, of accuracy, and of non-infringement of third party rights. We do not warrant that the functions contained in LOQT will meet your requirements, that LOQT will be uninterrupted or error-free, or that defects will be corrected. 

Limitation of Liability 

We assume no liability or responsibility for any errors, mistakes, or inaccuracies of content; personal injury or property damage resulting from your access to and use of LOQT; any unauthorised access to or use of our servers and any personal information stored therein; any interruption or cessation of transmission to or from LOQT; and any bugs, viruses, trojan horses, or the like which may be 

transmitted to or through the products by any third party. 

Our aggregate liability arising out of your use or purchase of LOQT will not exceed the price paid for the use of LOQT by you. 

Indemnity 

You agree to defend, indemnify and hold harmless Do It Get It Ltd, its affiliates and their respective successors and assigns, officers, directors, employees and agents, from and against any and all claims, damages, obligations, losses, liabilities, costs and expenses arising from: your use of and access to LOQT; your violation of any of the Terms set forth herein; your violation of any third party right; or any claim that your conduct caused damage to a third party. 

Governing Law 

These Terms and the use of any Service from LOQT shall be governed by and construed in accordance with the laws of England and Wales and will be subject to the exclusive jurisdiction of the courts of England and Wales. 

Time Limitation 

Any cause of action arising out of or related to your use of LOQT must commence within one (1) year after the cause of action occurs. Otherwise, such cause of action is permanently barred. 

Assignment 

You may not assign your rights under these Terms without our prior written permission and any attempt by you to do so shall be void. We may assign our rights and duties under these Terms to

any party at any time without notice to you. 

Availability 

We reserve the right to modify, update, supplement, limit, discontinue, remove or disable access to LOQT without notice to you. 

Updates 

You are only granted the right to the version of LOQT as provided when purchased. From time to time, we may make available updates to LOQT via software download or other means. We do not warrant, represent nor undertake to provide updates and in no event shall we incur any liability for a failure to do so. 

Changes to the Agreement 

We may make changes to these Terms at any time by notifying you of the change. A new copy of the updated Terms shall be made available on our website. By using LOQT after such changes are made, you signify that you agree to be bound by such changes. 

Termination 

These Terms are effective until terminated by you or us. Your rights under the license granted herein shall terminate automatically without notice from us if you fail to comply with any of the terms and conditions contained herein. Upon termination of these Terms for any reason, you shall cease all use of LOQT and destroy all copies thereof.
